Subject: Trespass and Misconduct
Dear Mr. Boring,
I am writing to formally address a series of serious concerns regarding the conduct of Department Manager Nick Babcock, who has repeatedly trespassed on my property and engaged in unprofessional behavior that has negatively impacted my business, Dancing Goat Creamery, as well as Brookwood Farms II, our food license and any other licenses under our names. Below are the specific but not limited to instances of misconduct:
Trespass and Misconduct Incidents
1. Unauthorized Photography: On April 1st, Inspector Kozloski took photographs of our sample products without permission or knowledge, intending to use these images against Dancing Goat Creamery. This was known and allowed by Nick as a manager.
2. Illegal Entry and Seizure: On April 15th, 17th, and 20th, Inspector kozloski entered my private property during closed hours without a warrant, took photographs of our products, and seized items from a food-licensed area. She inspected this area multiple times outside her pervue, seized property she didn’t touch through a small area of a window placing any and all alleged violations on Dancing Goat’s license instead of the licensed areas license. This was known and allowed by Nick.
3. Misrepresentation During Inspection: On April 8th, Inspector Kozloski unofficially took pictures of our information paperwork at at a creamery under the guise of a vat check, again without the owners’ knowledge, intending to use this information against our business. No due process. This was known and allowed by Nick.
4. Collusion with Abbie Rowell: Since at least April 1st, Inspector Kozloski and Nick Babcock have been collaborating unofficially with Abbie Rowell to plan an investigation without due process to lead to loss of license. They have requested vague information and refused to clarify the scope of their inquiries, intending to use this information against us. This is known and allowed by Nick.
5. Denial of Reinstatement Inspection: Inspector Kozloski denied our right to a reinstatement inspection, which would have allowed us to prove the allegations against us were false, without impedeing our constitutional rights and causing his monetary harm with expensive court proceedings. This is known and allowed by Nick.
6. Inappropriate Surveillance: Inspector Kozloski took multiple photographs of our vehicles at various times, which are unrelated to any laws she is enforcing.
This is known and allowed by Nick.
7. Nick came to our residence unannounced with a state vet outside the pervue of his area in Mdard. He did not let us know he was there or for what reason before trying to enter our facility which was trespassing, he was seen on video. The state vets stated they did not ask him to come and have never had to coordinate with a dairy inspector for "suspected" animals and do not know why this had to occur.
8. False Statements: Inspector Kozloski has provided incorrect information regarding suspension dates and reasons for her actions. This is known and allowed by Nick.
9. Unwarranted Entry on May 4th: On this date, Inspector Kozloski and NICK had a warrant but did not present it to the owner, but still entered sanitary plant without presenting a warrant or obtaining permission. They walked around areas of animal filth and barns before entering the sanitary plant without proper protective gear. Furthermore, they entered the food-licensed area outside the scope of her warrant. They placed product on the floor and then back into freezers.
10. Leaving Doors Open: After their illegal entry on May 4th, they left multiple doors to the outside open for hours, creating a security risk.
11. False Claims to Authorities: Inspector Kozloski misrepresented the situation to officers, alleging that I barricaded myself inside the creamery refusing to answer the door, which posed a dangerous situation for me and my family, and officers to imagine a middle aged crazy lady hiding with a gun. Nick was present and allowed this.
12. Community Intimidation: Inspector Kozloski has spoken to multiple community members about my processing plant and other smaller facilities license information and has bragged and admitted to inviduals of intimidating and targeting small farms due to their financial situations, providing specific violations that only someone with insider knowledge would know. Nick was made aware of this and refused to handle the issue himself as her boss/manager. Nick also has allegedly told community or other people that we stopped at his house and caused a big ruckus while trying to deliver court papers. Which is untrue Nick was seen at the sliding door peeking through did not answer and went and hid, he was contacted by text after we left.
13. NICK has been sued personally for degradation of constitutional rights as well as other claims. So is now conflict of interest and puts any inspection or investigation not in neutral territory.
14. Nick tried to influence and manage our herd share program on our farm which is outside his pervue or MDARD's scope tried using a quarantine through Mdard veterinarians who have nothing to do with the sale of milk outside of the positive or "suspected animals". The herdshare animals were all negative tested animals and not his place.
Given the serious nature of these incidents, I am stating that Manager Nick is from this date and time from entering my property and participating in any future licensing matters related to Dancing Goat Creamery, Brookwood Farms, or any other licenses under our name or address, and will be criminally trespassed by officers if he does so come on property. If Mdard refuses other legally matters towards Mdard will take place. This action is mainly due to Mdard management lack of correcting many actions over the year resulting in emails, text messages, online complaints, cease and assist letter with little to no response or care for correcting an employee whom was degrading constituitional rights under the color of law when reported to management.
Sincerely,
Amanda ferris.
