“All Natural.” $9 million. Settled in court.

Naked Juice — owned by PepsiCo out of Pleasanton, California — spent years selling bottles labeled “All Natural,” “100% Juice,” and “Non-GMO.” Plaintiffs in five consolidated class action suits alleged the bottles actually contained Fibersol-2 (a processed corn-derived fiber from ADM), synthetic fructooligosaccharides, inulin, and genetically modified soy — additives the suit argued couldn’t reasonably be called “all natural.”

PepsiCo denied wrongdoing. Then settled for $9 million in 2013, paid eligible consumers up to $75 each, and quietly agreed to drop “All Natural” from the label going forward.

Here’s the part that lingers: the bottle stayed on shelves the whole time the case was being litigated. By the time the label finally changed, millions of consumers had already paid the “all natural” premium for what they thought they were buying.

Eight people across Maryland, New York, and Virginia have been infected with the same Listeria strain linked to requeson soft cheese from Clover Hill Dairy. Seven have been hospitalized. One person has died.

In the summer of 2024, a Listeria outbreak traced to a Boar’s Head deli meat plant in Jarratt, Virginia killed ten people and hospitalized 59. Federal investigators documented years of filth at the facility — mold, insects, dripping condensation — that USDA inspectors had repeatedly walked past without shutting it down.

The DOJ was formally asked to determine whether criminal charges were warranted. The USDA Inspector General opened a review of how its own inspectors let the plant keep operating. Two members of Congress referred the matter directly to the Attorney General. USDA refused FOIA requests for inspection records, citing an active law enforcement investigation.

That was twenty months ago. The plant has since been rebuilt and reopened. The news cycle has moved on. And from both the DOJ and the IG — the two investigations that actually matter for accountability — the public record shows a long, deliberate silence. No indictment. No charges. No public report. No explanation.
