With the upcoming Peak Market season upon us, we are getting a number of inquiries for vendors wanting to sell cheesecakes, pies, cakes, & other items that cannot be produced under cottage law. We’d like to remind local food makers producing out of their home that there are rules that vendors must follow.
Depending on your product, these are set by Virginia Department of Agriculture and Consumer Services (VDACS) or Virginia Department of Health (VDH).
It is a common misconception that all baked goods fall under cottage law. We receive many inquiries from at-home food makers to participate in market selling items like pies, cheesecakes, cream-based pies, cakes & more. THESE ITEMS ARE NOT PERMITTED UNDER COTTAGE LAW. THEY MUST BE HELD UNDER TIME/TEMPERATURE CONTROL (refrigeration or freezing) AFTER BAKING.
Our Market vendors who produce these items are doing so out of an owned or leased health department inspected facility OUTSIDE of their homes. A completely different ball game. We check these inspection certificates to ensure that we are only offering safely produced foods at our Market.
Bakers & consumers- PLEASE, please, please make yourself aware of what the laws actually are. We have no desire to see consumers suffer from food poisoning nor see a small business owner entangled in a legal dispute due to ignorance of the law.
